Townsend, Tomaio & Newmark Attorney Succeeds in Alimony Modification Appeal

Bergen County NJ Post-Divorce Modification and Family Law Appeals Attorneys

Earlier this month, Townsend, Tomaio & Newmark attorney Gregory Pasler secured a successful NJ Appellate Division verdict for his client Mr. Keller of Somerset County.

Mr. Pasler appealed on behalf of his client after the Trial Courts ruled against Mr. Keller’s alimony and child support modification request following a change in his employment. Specifically, Mr. Keller took a roughly 50% reduction in salary from $582,000 per year to $250,000 per year when he lost his job as general counsel of Lucent, and then secured in a new position in Pfizer. However, the trial judge during Mr. Keller’s support modification request found that there were not sufficient changes in Mr. Keller’s financial circumstances to warrant an alimony modification or child support modification, stating that Mr. Keller would still be able to earn close to his original salary through bonuses and additional compensation.

Gregory Pasler quickly appealed the Trial Court’s decision on behalf of his client, and NJ Appellate Division Judges Karen Suter and Jane Grall both found that the Trial Judge in the original matter failed to consider all of the 23 factors outlined in New Jersey’s 2014 Alimony Reform Act, including the fact that such a significant change in income should have resulted in a reconsideration of alimony and child support payments.

In his statement to the press following this successful ruling, Mr. Pasler stated ” “The appellate court’s decision clearly confirms that … the trial court cannot summarily dismiss an obligor’s request for a modification of their support obligations should they experience a loss of income.”
